The CNMC has also rejected the review requested by Atresmedia of the conditions that prevent it from marketing third-party free-to-air channels by not admitting that Mediaset España's agreements with TNT and 13TV have in any way altered the conditions of competition in the television advertising market.

The National Markets and Competition Commission (CNMC) has dismissed and filed a complaint by Atresmedia against Mediaset España for the marketing of 13TV and TNT, considering that there are no indications of infringement of competition regulations in the agreements for the management of the advertising of these channels by Mediaset España.

The CNMC has also rejected the review requested by Atresmedia of its prohibition to market advertising from third-party free-to-air channels, maintaining the conditions derived from the concentration process of Antena 3 and La Sexta by not admitting, as Atresmedia intended, that there has been a substantial and sustained modification of the conditions of competition in the television advertising market as a consequence of the validity of the agreements signed between Mediaset España and 13TV and TNT.

The CNMC has concluded that the contract with 13TV does not have restrictive effects on the television advertising market given the low commercial weight of said channel, the short duration of the agreement signed, as well as the conditions regarding the establishment of the commercial policy by Mediaset España. Regarding the contract signed with TNT, the CNMC has considered that the potential risk of it being a restrictive agreement on competition is even lower given that it is a pay television channel, whose commercial strategy is not based on obtaining advertising revenue and has a much smaller audience than that of any free-to-air television.
