The CNMC confirms that Mediaset España complied with all the commitments derived from the acquisition of Sogecuatro

In its latest Report corresponding to the January 2014-April 2016 biennium, the CNMC declares that Mediaset España has faithfully and strictly complied with all the commitments to which the former CNC subordinated the Telecinco and Cuatro concentration operation, and declares the definitive closure of the surveillance actions.

The National Markets and Competition Commission (CNMC) has confirmed in its latest Surveillance Report between January 2014 and April 2016, that Mediaset España has fulfilled all the commitments that were established in the Sogecuatro acquisition process, both in advertising and in the acquisition of audiovisual content. Furthermore, it firmly declares the closure of the surveillance actions of said concentration operation.

The CNMC thus concludes its report after analyzing in detail the actions of Mediaset España with respect to these commitments, which involved the establishment of certain restrictions when marketing advertising on television and acquiring content in order to avoid abuse derived from the hypothetical dominant position that Mediaset España would hold in both markets (advertising and content) after the purchase of Cuatro and 22% of the former payment platform Digital+.

Estos compromisos fueron desarrollados e impuestos de forma unilateral por la extinta CNC mediante un Plan de Actuación que Mediaset España impugnó en vía jurisdiccional, y por cuyo presunto incumplimiento interpuso a esta compañía varias sanciones injustificadas y desproporcionadas, que en algún ya caso han sido minoradas sustancialmente.
