The CNMC opens 4 sanctioning files against Mediaset and Atresmedia for breaches of the audiovisual communication law

These events could involve serious administrative infractions, which would entail penalties of between 100,001 and 500,000 euros.

The National Markets and Competition Commission (CNMC) has approved the opening of 4 sanctioning files against Atresmedia and Mediaset for possible non-compliance with articles 14.1 and 14.4 of the General Law of Audiovisual Communication (Law 7/2010).

Specifically, Mediaset (file SCN/DTSA/1634/2014) on its television channels Telecinco, Cuatro and FDF, and Atresmedia (file SNC/DTSA/1731/2014) on its television channel LA SEXTA, have been able to violate the provisions of art. 14.1 of the LGA exceeding the broadcast time limit dedicated to advertising and telesales messages. These events could involve minor administrative infractions, which would entail penalties of up to 100,000 euros.

The other two open sanctioning files refer to non-compliance with article 14.4 of the LGA due to advertising interruptions in some programs, without respecting their integrity, in such a way that the interests of viewers are harmed. In this case, it affects the Divinity and Energy channels of Mediaset (file SCN/DTSA/1748/2014) and NEOX and NOVA, of Atresmedia (file SCN/DTSA/1753/2014).

Estos hechos podrían suponer infracciones administrativas de carácter grave, que conllevarían sanciones de entre 100.001 y 500.000 euros. No obstante, la incoación de estos expedientes no prejuzga el resultado final de la investigación. Se inicia así un período máximo de 6 meses para la instrucción del expediente y para su resolución. Los operadores tienen 15 días para presentar alegaciones.
