The CNMC opens a sanctioning file against Atresmedia for failing to comply with the conditions of the merger of Antena 3 and LaSexta

In Comperencia's opinion, the company has not respected the conditions related to the acquisition of content at the same time that there are indications of linking advertising discounts to global investment quotas in the group's channels.

Atresmedia HeadquartersThe National Markets and Competition Commission (CNMC) has agreed to initiate disciplinary proceedings against Atresmedia for failing to comply, in its opinion, with certain conditions to which the authorization of the concentration operation of Antena 3 and LaSexta was subordinated.

Specifically, for the CNMC there are indications that Atresmedia would have de facto linked the marketing of television advertising for the two channel packages it markets, among others, through the application of a discount policy based on compliance with a global investment quota in Atresmedia's group of channels.

Likewise, there is evidence of non-compliance with some of the obligations related to the audiovisual content acquisition markets; specifically, those referring to the writings that must be sent to content providers to adjust the terms of the contracts to the limits set in the conditions and waive preferential clauses, as well as those referring to the sending of documentation to the CNMC to facilitate the monitoring of said conditions.

Ante este marco, la Dirección de Competencia ha acordado la incoación de expediente sancionador contra Atresmedia por infracción del artículo 62.4 c) de la Ley 15/2007, de 3 de julio, de Defensa de la Competencia. Ahora se abrirá un período máximo de seis meses para la instrucción del expediente y para su resolución por la CNMC.
