EGEDA will appeal the ruling in the Series Yonkis case
Following the ruling of the Criminal Court No. 4 of Murcia in the Series Yonkis case, EGEDA, a party in the judicial process against the Administrators of Movies Yonkis and Series Yonkis, announces that it will appeal said ruling.
In relation to the ruling of the Criminal Court No. 4 of Murcia in the case Series Yonkis, EGEDA, the Entity for the Management of the Rights of Audiovisual Producers, represented in the judicial process followed against the Administrators of the web pages www.peliculasyonkis.com y www.seriesyonkis.com, announces that it will appeal said sentence.
The ruling recognizes that the defendants made all types of audiovisual content, both films and television series, available to the public on the Internet, in an unauthorized manner through links. Through this method, they obtained income of more than 900,000 euros derived from the advertising inserted in the pages and the sale of said pages.
The Directive 2001/29/EC of the European Parliament and of the Council, recognizes that the activity of linking to pages that disseminate content not authorized by their owners, constitutes in itself an act of public communication as it has been interpreted by the ruling handed down by the Court of Justice of the European Union (CJEU) in the Sevensson case. This interpretation should have been applied in the case of Series Yonkis, following the criteria of the Supreme Court in its ruling of October 10, 2012, which indicated that the CJEU Sentences are binding on national courts from the date of entry into force of the Standard they interpret.
Among the activities that EGEDA has been carrying out in defense of audiovisual producers since its creation, and especially those that affect the fight against the distribution of content produced illegally, the entity assures that it will take all legal actions within its reach aimed at defending the interests of intellectual property rights.
The strengthening of clear legislation and policy in the defense of intellectual property rights is essential to promote the Audiovisual Industry that generates culture and employment, so necessary in our society and to which EGEDA is especially committed.
