The Italian justice orders Vimeo to eliminate all Mediaset videos and compensate the group with 8.5 million euros

The Rome court recognizes the nature of Vimeo as an active hosting service, similar to a video-on-demand service.

The court of Rome has accepted the thesis of Mediaset Italy condemning Vimeo in response to the lawsuit filed by the Italian media group. Now, the platform will be forced to delete all videos from Mediaset Italia and to compensate the rights holder with 8.5 million euros.

In the ruling, the court recognizes the nature of Vimeo as an active hosting service, similar to a video-on-demand service, determining that Mediaset was right to sue the American online video platform for the publication of content protected by copyright.

According to the ruling, Vimeo can “identify, in the context of the material present on the digital platform, that corresponding to certain illicit content.”

Vimeo will also have to prevent new uploads of unauthorized content, under penalty of a fine of 1,000 euros for each individual violation and a fine of 500 euros for each day of delay in removal.

In addition to the above sanctions, Vimeo is obliged to publish the ruling device in the print and online editions of two Italian newspapers and on the home page of its portal Vimeo.com.

For Mediaset, “it aims to harmonize copyright laws in different countries to protect the creative industry and publishers who, like Mediaset, create content by regularly rewarding the rights of all authors.”
