A report denounces the non-compliance with the audiovisual regulations of the Basque streaming platforms

The consultant AVC Audiovisual Compliance, specialized in audiovisual regulatory compliance, has denounced through its report “Streaming platforms in the Basque Country: Do they comply with audiovisual regulations?” that the ten main Basque audiovisual platforms suffer significant deficiencies in terms of compliance with audiovisual regulations.

According to the AVC report, the ten platforms analyzed, Canal Guggenheim Bilbao, ETB On, Euskal Kirola Telebista, Filmoteca Vasca, Gookapi, GUAU, INGURA, irun.market OTT, Makusi y Primeran, they fulfill the General Law of Audiovisual Communication (LGCA) in a “partial, and sometimes scarce” way. In fact, according to the study, none of the platforms analyzed “compliance 100%.” Additionally, with regard to the Cinema Law, in those Basque streaming services where it is applicable, “is completely non-existent.”

On the other hand, the LSSI (Information Society Services Law), although it is not an exclusively audiovisual standard, it does directly affect its web pages and none of the ten obeys her completely. Meanwhile, in the legal notice texts, keeps appearing inexplicably in the information related to the audiovisual communication service providers the term CIF, which disappeared in 2008 in favor of the NIF. Likewise, nine of them do not follow the dictates established for the Cookie Notice, and one even does not even include it. In addition, Anti-Piracy protection is weak and its audiovisual content can be subject to illicit downloading.

In summary, following the usual trend of the national panorama of streaming services, always according to AVC itself, the basque platforms (and their providers) “They only partially apply the current audiovisual regulations (and that which directly affects them), and despite the possible economic sanctions or the lack of protection of minors, “None of them manages to fulfill it completely.”
